Empowering Uganda’s Muslim Families: Dr. Adam Musa’s Journey from IIUM to Reforming Matrimonial Laws through Maqasid Shari’ah
Dr. Adam Musa, a proud graduate of the International Islamic University Malaysia (IIUM), marked a significant milestone at the 41st convocation in 2025 by earning his PhD with a pioneering thesis titled “Curbing Matrimonial Problems in Uganda via Regulating Walk Away Practices basing on Maqasid Shari’ah Approach.” His study offers an innovative and comprehensive evaluation of Uganda’s Muslim Family Laws, identifying crucial gaps and proposing reforms to protect and strengthen family institutions across the country.
Drawing from the principles of Maqasid Shari’ah, the higher objectives of Islamic law from Dr. Musa’s research rigorously analyzes the 1906 Muhammadan Ordinance (Chapter 252, Article 129 D (i)) and other family protection provisions. His work is unique in that it extensively involves the perspectives of all key stakeholders: couples, Imams, Muslim leaders (Qadhi/Muftis), judiciary members, legislators, and the executive branch.
Reflecting on his academic journey, Dr. Musa advises fellow students, “Let them not lose the momentum, but keep on making smaller steps, be disciplined, and focus on the thesis; insha’Allah, they will make it in this very difficult academic journey.” His encouragement resonates with those pursuing long and challenging paths, emphasizing discipline and steady progress.
Looking ahead, Dr. Adam Musa envisions a significant impact of his doctoral work across Uganda. He believes Muslim Family Laws need urgent reforms to fully benefit all involved husbands and wives, religious leaders, the judiciary, lawmakers, and civil society organizations. His vision aligns with reforms already embraced by sovereign nations like Kenya, India, and Singapore, which have modernized their Muslim personal laws to safeguard family institutions from abuse and neglect.
Dr. Musa’s groundbreaking study offers a vital blueprint for Uganda to follow, reinforcing family values and legal protections through well-regulated practices grounded in Islamic legal philosophy. As the country moves towards legal reforms, his work provides pivotal insight to policymakers and stakeholders committed to strengthening family welfare and justice.
